109 CIS Legis. Hist. P.L. 9 (109 PL 9) SUMMARY: Recommends passage, with an amendment in the nature of a substitute, of H.R. 4077, the Piracy Deterrence and Education Act of 2004, to amend the Trademark Act of 1946 to enhance criminal enforcement of copyright laws.
Includes provisions to:
a. Authorize Department of Justice to establish a pilot program to provide Internet service subscribers who appear to be engaging in copyright infringement with warning notices explaining the penalties for such copyright infringement.
b. Require Department of Justice to establish a program to educate consumers about copyright law involving Internet use.
c. Require Department of Justice to ensure that any unit responsible for investigating computer hacking or intellectual property crimes is assigned at least one agent to support the unit in investigating crimes relating to the theft of intellectual property.
d. Authorize FY2005 appropriations for Department of Justice enforcement of copyright laws, and increase penalties for copyright infringement.
e. Prohibit the use of audiovisual recording devices to transmit or copy motion pictures or other audiovisual work in movie theaters.
f. Clarify that use of certain technologies to filter content out of movies for private viewing is not a violation of copyright or trademark law.
Section 12 is cited as the Family Movie Act of 2004.
