109 CIS Legis. Hist. P.L. 9 (109 PL 9) SUMMARY: Recommends passage of S. 167, the Family Entertainment and Copyright Act of 2005, to amend the Trademark Act of 1946 and the National Film Preservation Act of 1996 to make miscellaneous revisions to intellectual property law, in the following titles:
Title I, the Artists' Rights and Theft Prevention Act of 2005, to:
a. Prohibit the use of audiovisual recording devices to transmit or copy motion pictures or other audiovisual works in movie theaters.
b. Establish criminal penalties for the willful distribution of motion pictures or other audiovisual works prior to their commercial release.
c. Require the Copyright Office to establish a pre-registration system for copyrighted works, and direct the U.S. Sentencing Commission to review and update as appropriate the sentencing guidelines for certain intellectual property crimes.
Title II, the Family Movie Act, to clarify that use of certain technologies to filter content out of movies for private viewing is not a violation of copyright or trademark law.
Title III, the National Film Preservation Act of 2005, to authorize FY2005-FY2009 appropriations for and revise operations of the National Film Preservation Board and the National Film Preservation Foundation.
Title IV, the Preservation of Orphan Works Act, to make a technical correction to Sonny Bono Copyright Term Extension Act.
